Agreement to Terms

These Terms of Service ("Terms") govern your use of the WasteSplit mobile application for iOS and Android, the WasteSplit website at wastesplit.com, and related services (collectively, the "Service"). These Terms form an agreement between you and Aether Labs ("Company," "we," "our," or "us").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy.

1. Our Services

WasteSplit is an AI-powered waste classification application. You can take a photo of a waste item and receive suggested disposal categories, disposal instructions, nearby recycling and drop-off facilities, and alternatives to disposable products.

Important Disclaimers

Your use of the Service constitutes your explicit acceptance of these disclaimers, the risks described herein, and the assumption of risk and limitation of liability described in Section 9.

AI Classification: WasteSplit uses AI to generate results, which may be inaccurate. Always verify disposal methods with your local waste management authority, especially for hazardous materials.

Facility Information: Facility recommendations are provided by third-party data sources. WasteSplit does not verify facility hours, accepted materials, or operations. Call facilities before visiting.

Third-Party Links: The Service may recommend alternative products with links to third-party websites. Some links may be affiliate links where we earn a commission at no extra cost to you. We are not responsible for third-party content, availability, or your purchases.

2. Eligibility

2.1 Age Requirement

You must be at least 18 years of age to use the Service. By using the Service, you represent that you meet this age requirement.

2.2 Geographic Availability

The Service is available only in regions where it is distributed through the Apple App Store or Google Play Store. By using the Service, you represent that you are located in a region where the Service is available and that your use complies with all applicable local laws and regulations. Facility recommendations may be limited or unavailable in some regions.

2.3 Account Requirements

To use the Service, you must create an account. You agree to provide accurate information, maintain the security of your password, and accept responsibility for all activities under your account. You may not share your account credentials with anyone else.

2.4 Intended Use

The Service is designed exclusively for common household and personal waste disposal guidance. The Service is not intended for industrial, commercial, manufacturing, medical, laboratory, agricultural, or construction waste. If you generate waste in a commercial or professional capacity, you must consult licensed waste management professionals and comply with applicable environmental regulations.

3. User Responsibilities

By accessing or using the Service, you agree to comply with the following:

  1. Verify Classifications: Always verify waste classifications with your local waste management authority before disposal. Local authority guidance takes precedence over any Service recommendations.
  2. Handle Hazardous Materials Properly: Do not dispose of hazardous, biohazardous, or medical waste based solely on AI classification. Refer to authoritative government sources (such as the EPA or your local environmental agency) or contact certified disposal facilities for guidance.
  3. Confirm Facility Information: The Service may suggest nearby disposal or recycling facilities. Call facilities before visiting to confirm hours, location, and accepted waste types, and follow the facility's instructions for proper disposal.
  4. Upload Appropriate Content: Only upload photos of waste items. Do not upload photos containing personal information, faces of identifiable individuals, illegal content, or copyrighted material you don't own.
  5. Comply with Laws: Follow all applicable waste disposal laws and regulations.

4. Prohibited Uses

You agree not to engage in any of the following prohibited activities:

  1. Circumvent rate limits, abuse the Service, or use automated systems to access the Service outside of approved interfaces.
  2. Reverse engineer, decompile, or disassemble the Service. Use Service outputs to train AI or machine learning models. Service outputs are for personal use within the application only.
  3. Upload malicious code or viruses, attempt unauthorized access to Service systems, or disrupt the Service for other users.
  4. Use the Service for harassment, abuse, or harm to others. Impersonate any person or entity. Use the Service for commercial purposes without authorization.
  5. Use the Service to promote, conduct, or facilitate any activity that violates local or international law.
  6. Upload content that infringes on any third party's intellectual property rights.
  7. Collect or harvest user data or personally identifiable information without authorization.
  8. Upload or generate content that is obscene, defamatory, hateful, or promotes violence or self-harm.

5. Intellectual Property

5.1 Our Intellectual Property

The Service, including its design, features, content, and technology, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

5.2 Your Content

You retain ownership of the photos and content you upload to the Service ("Input"). By uploading content, you grant us a non-exclusive, royalty-free, worldwide license to process your content through our AI classification systems, store your content for service provision, display your content back to you within the Service, and use anonymized data to improve our services.

5.3 Output

All classifications, instructions, and other responses generated by the Service ("Output") are owned by us. We grant you a limited, non-exclusive, non-transferable license to use Output for your personal, non-commercial purposes. Output may not be unique, and other users may receive similar results.

5.4 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use them without compensation or attribution.

6. Third-Party Services and Materials

The Service relies on third-party services and materials, including artificial intelligence and machine learning models, facility data providers, and product information sources ("Third-Party Materials"). By using the Service, you acknowledge and agree that we are not responsible for examining or evaluating the accuracy, completeness, timeliness, validity, or quality of such Third-Party Materials. We do not warrant or endorse, and will not have any liability or responsibility for, any Third-Party Materials or the products, services, or content of third parties. We reserve the right to change third-party providers at any time without notice.

7. Account Termination

You may delete your account at any time through the app settings. We may suspend or terminate your account at any time, for any reason, without notice. Upon termination, your right to use the Service ends immediately and your data will be handled in accordance with our Privacy Policy.

8. Indemnification

By entering into these Terms and accessing or using the Service, you agree to defend, indemnify, and hold harmless Aether Labs, its affiliates, officers, directors, employees, and agents (collectively, the "Aether Labs Entities") from and against any and all claims, costs, damages, losses, liabilities, and expenses (including reasonable attorneys' fees and costs) arising out of or in connection with: (a) your violation or breach of any term of these Terms or any applicable law or regulation; (b) your violation of any rights of any third party; (c) your misuse of the Service; (d) content you upload to the Service; (e) your waste disposal decisions or actions taken based on Service recommendations; or (f) your negligence or willful misconduct.

If you are obligated to indemnify any Aether Labs Entity, you agree that Aether Labs will have the right, in its sole discretion, to control any action or proceeding and to determine whether to settle, and if so, on what terms. You agree to fully cooperate with Aether Labs in the defense or settlement of such claim.

9. Limitation of Liability

9.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR RELIABILITY OF CLASSIFICATIONS, ACCURACY OF FACILITY INFORMATION, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

9.2 Assumption of Risk

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. You acknowledge that AI and machine learning technologies are evolving and may produce inaccurate or incomplete results. You should not rely on Service outputs as the sole source of truth, professional waste management advice, or substitute for consulting local authorities.

9.3 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AETHER LABS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

even if we have been advised of the possibility of such damages.

9.4 Liability Cap

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR $100 USD.

9.5 Jurisdictional Limitations

Some jurisdictions do not allow the disclaimer of certain warranties or limitation of certain damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

10. Disputes and Class Action Waiver

10.1 Informal Resolution First

If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting us at legal@wastesplit.com for a period of no less than sixty (60) days before initiating any court proceeding. This informal dispute resolution process is a prerequisite to any formal action.

10.2 Class Action Waiver

YOU AND AETHER LABS AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit against Aether Labs.

11. Governing Law and Venue

These Terms and any dispute or claim arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. You agree that any legal action arising out of or relating to these Terms or the Service must be filed exclusively in the courts located in New Delhi, India. Nothing in this section shall deprive you of any mandatory consumer protection rights in your jurisdiction of residence that cannot be waived by contract.

12. Changes to Terms

We may modify these Terms at any time. For material changes, we will notify you via email or in-app notification at least 30 days before changes take effect. Continued use after changes constitutes acceptance. If you do not agree to updated Terms, you must stop using the Service.

13. General Provisions

Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Aether Labs.

Severability: If any provision is found unenforceable, the remaining provisions continue in effect.

No Waiver: Our failure to enforce any provision does not waive our right to enforce it later.

Assignment: You may not assign these Terms. We may assign to an affiliate or successor.
